  • a guarantee that a development will be approved

Every property and construction project is different.

Before making decisions, you should obtain appropriate project-specific advice and investigations.

3. Construction Services

Syntra may provide services including:

  • feasibility discussions
  • consultant coordination
  • estimating
  • budgeting
  • design coordination
  • procurement
  • construction management

The exact scope of services for a project will be set out in a separate quotation, proposal, preliminary services agreement, building contract or other written agreement.

Where there is any inconsistency between these Website Terms and a separately executed agreement with Syntra, the separately executed agreement will apply to the extent of the inconsistency.

4. Building Contracts

A website enquiry, consultation, estimate or quotation does not itself create a residential building contract unless expressly stated otherwise and all applicable legal requirements have been satisfied.

Where building work requires a formal building contract, construction will be governed by the terms of that contract.

Nothing in these Website Terms excludes, restricts or modifies any right, warranty or obligation that cannot lawfully be excluded under applicable legislation.

5. Initial Consultations

Syntra may offer paid or complimentary initial consultations.

An initial consultation is intended to help:

  • understand your project objectives
  • discuss the property
  • identify potential project requirements
  • discuss preliminary budget considerations
  • identify consultants or investigations that may be required
  • outline potential next steps

An initial consultation is not a complete feasibility assessment and should not be relied upon as confirmation that a project will receive approval, that a particular design can be constructed, that a property can be developed in a particular way, that a project can be completed for a particular amount, or that there are no site, title, planning or construction constraints.

Further investigations may be required.

6. Preliminary Services

Syntra may provide preliminary or pre-construction services separately from construction services.

These services may include:

  • site inspections
  • preliminary assessments
  • concept discussions
  • estimating
  • consultant coordination
  • design coordination
  • obtaining quotations
  • reviewing plans
  • project planning

Where fees apply, the relevant scope, deliverables and fees will be communicated before the service is undertaken.

Payment for preliminary services does not guarantee that Syntra will subsequently enter into a construction contract.

7. Estimates, Budgets and Cost Calculators

Any estimate, budget, cost range or calculation provided through the Website is indicative only unless Syntra expressly states otherwise in writing.

Indicative pricing may be based on assumptions relating to matters including:

  • project size
  • construction type
  • floor area
  • finishes
  • site access
  • ground conditions
  • demolition
  • excavation
  • structural requirements
  • services
  • council requirements
  • certification
  • consultant fees
  • authority charges
  • statutory contributions
  • labour costs
  • material costs

Actual project costs can vary materially.

An online cost calculator, preliminary estimate or consultation figure is not a quotation or fixed price construction offer.

8. Quotations

A quotation issued by Syntra is subject to the terms stated within that quotation.

Unless otherwise stated, quotations may be subject to:

  • site inspection
  • final plans and specifications
  • engineering
  • surveying
  • geotechnical information
  • selections
  • planning requirements
  • certification requirements
  • authority requirements
  • availability of materials
  • subcontractor pricing
  • site conditions
  • applicable taxes and statutory charges

A quotation does not become a binding building contract simply because it has been provided through the Website or by email.

9. Planning and Development Approval

Syntra may discuss planning pathways including development applications, complying development and other approval processes.

However, final approval decisions may be made by third parties including:

  • councils
  • private certifiers
  • Building Commission NSW
  • government authorities
  • utility providers
  • planning authorities

Syntra cannot guarantee approval of any development or construction proposal.

Planning controls, policies and legislation may also change over time.

10. Property Information

You are responsible for providing information that is accurate, complete and not misleading.

This may include information relating to:

  • property ownership
  • property address
  • boundaries
  • easements
  • covenants
  • restrictions on title
  • existing structures
  • services
  • previous approvals
  • existing plans
  • known site conditions

Syntra may rely on information supplied by you or third parties when providing preliminary advice.

We are not responsible for inaccuracies resulting from incorrect, incomplete or outdated information supplied to us.

11. Site Conditions

Construction pricing and project feasibility can be affected by site conditions that may not be reasonably identifiable during an initial assessment.

These may include:

  • rock
  • unsuitable soil
  • contamination
  • asbestos
  • underground structures
  • undocumented services
  • groundwater
  • stormwater conditions
  • access constraints
  • boundary discrepancies
  • retaining requirements
  • latent structural conditions

Any treatment of unforeseen site conditions will be governed by the applicable quotation, proposal or construction contract.

12. Third-Party Consultants

Syntra may recommend, coordinate or introduce third-party professionals including:

  • architects
  • building designers
  • engineers
  • surveyors
  • certifiers
  • town planners
  • geotechnical consultants
  • interior designers
  • subcontractors
  • suppliers

Unless expressly agreed otherwise, these third parties provide their services independently.

Syntra does not guarantee the performance, advice or services of an independent third party.

Where you engage a third party directly, your relationship with that provider is governed by your agreement with them.

13. Third-Party Websites and Services

The Website may contain links to external websites, calculators, booking platforms or other third-party services.

Syntra does not control these services and is not responsible for their availability, accuracy, content, security, privacy practices or terms of use.

You should review the terms and privacy policies of third-party providers before using their services.

14. Payments

Where you purchase a consultation, preliminary service or another service through the Website:

  • prices are in Australian dollars unless stated otherwise
  • GST will apply where legally required
  • payment may be processed by a third-party payment provider
  • you must provide accurate billing information
  • payment must be made in accordance with the stated payment terms

Separate payment terms may apply under quotations, preliminary services agreements or construction contracts.

15. Cancellations and Rescheduling

Cancellation, refund and rescheduling conditions for consultations or preliminary services may be displayed when booking or included in a separate agreement.

Where no separate conditions are provided, Syntra may determine whether a booking can be rescheduled based on reasonable notice and availability.

Nothing in this section excludes rights available under the Australian Consumer Law.

16. No Guaranteed Project Outcome

Syntra will provide services with the level of care and skill required by applicable law and any relevant agreement.

However, project outcomes can be affected by matters outside Syntra's reasonable control, including:

  • government approvals
  • council requirements
  • certification
  • weather
  • material availability
  • labour availability
  • supply chain delays
  • utility authorities
  • client decisions
  • design changes
  • variations
  • third-party consultants
  • latent site conditions
  • legislative changes

Nothing displayed on the Website guarantees a particular construction timeframe, approval, value increase, investment return or financial outcome.

17. Variations

Construction projects frequently change during design and construction.

Any variation to contracted building work will be handled in accordance with the applicable construction contract and relevant legislation.

Website discussions, text messages, social media messages or general enquiries should not be treated as approved contractual variations unless they satisfy the requirements of the applicable contract and law.

18. Intellectual Property

Unless otherwise stated, all intellectual property associated with the Website and Syntra materials is owned by or licensed to Syntra.

This includes:

  • videos
  • graphics
  • branding
  • cost calculators
  • templates
  • checklists
  • guides
  • project management frameworks

  • marketing materials

You may access these materials for your own personal or internal business use.

You must not, without prior written permission, reproduce substantial portions of our materials, republish our materials, sell or commercially exploit our materials, modify our materials and represent them as your own, or use our branding without permission.

19. Plans, Drawings and Designs

Plans, concepts, drawings and designs may be subject to intellectual property rights belonging to Syntra or third-party designers.

Payment for design or construction services does not automatically transfer ownership of intellectual property unless expressly agreed in writing.

The applicable consultant agreement, design agreement or construction contract will determine your rights to use project-specific plans and documentation.

20. Website Availability

We aim to keep the Website reasonably available and accurate.

However, we do not guarantee that:

  • the Website will always be available
  • the Website will be free from technical errors
  • all information will always be current
  • all features will operate without interruption

We may change, suspend or remove Website content or functionality at any time.

21. Prohibited Use

You must not use the Website:

  • fraudulently
  • to interfere with the Website

23. Home Building Legislation

Where Syntra undertakes residential building work, applicable rights and obligations may arise under the Home Building Act 1989 (NSW) and related legislation.

These may include statutory warranties and requirements applying to residential building contracts.

Nothing in these Terms is intended to exclude or limit those statutory rights or obligations.

24. Limitation of Liability

To the maximum extent permitted by law, Syntra is not liable for indirect or consequential loss arising solely from your use of the Website or reliance on general Website information.

This may include loss of:

  • profit
  • revenue
  • opportunity
  • anticipated savings
  • business
  • goodwill

This limitation does not apply where liability cannot legally be excluded or limited.

Nothing in these Terms limits Syntra's liability where doing so would breach the Australian Consumer Law, the Home Building Act 1989 (NSW), or another applicable law.

25. Indemnity

To the extent permitted by law, you agree to indemnify Syntra against loss reasonably incurred as a direct result of:

  • your unlawful use of the Website
  • information knowingly provided by you that is false or misleading
  • your infringement of another person's intellectual property rights
  • your material breach of these Terms

This clause does not require you to indemnify Syntra for loss caused by Syntra's own negligence, breach of contract or unlawful conduct.

26. Privacy

Your use of the Website is subject to our Privacy Policy.

Our Privacy Policy explains how Syntra collects, uses, stores and discloses personal information.

27. Changes to These Terms

Syntra may update these Terms from time to time.

Any updated Terms will apply from the date published on the Website.

Changes to these Website Terms do not retrospectively amend a separately signed construction contract or other agreement.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the minimum extent necessary.

The remaining provisions will continue to operate.

29. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You submit to the jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
